ATABEY Jewelry is a trade name under which Beechi LLC conducts business. References throughout this website to “ATABEY,” “ATABEY Jewelry,” “we,” “us,” or “our” refer to Beechi LLC doing business as ATABEY Jewelry, as applicable.

Except where otherwise stated, Beechi LLC d/b/a ATABEY Jewelry reserves all rights it may possess under applicable law in the original and legally protectable elements of the ATABEY brand, website, products, designs, and creative materials.

  • Original sculptural and ornamental elements
  • Original combinations, arrangements, and modifications of jewelry components
  • Original artwork and illustrations
  • Product photography
  • Videos and audiovisual materials
  • Logos, trademarks, trade names, and brand identifiers
  • Graphic designs and visual assets
  • Packaging artwork and branded materials
  • Website graphics and original website content
  • Written copy, product descriptions, articles, and editorial materials
  • Original sketches, CAD files, renderings, technical drawings, and design documentation
  • Original human-authored elements incorporated into AI-assisted or digitally created materials

Access to this website or purchase of an ATABEY product does not transfer ownership of any intellectual property belonging to Beechi LLC or grant a license to reproduce or commercially exploit such intellectual property except where expressly authorized or otherwise permitted by applicable law.

All rights are reserved to the fullest extent permitted by applicable law.

2. ORIGINAL ATABEY JEWELRY DESIGNS

ATABEY develops jewelry through a variety of creative and production methods.

These may include designs created entirely by ATABEY, original sculptural interpretations, custom-designed components, modified components, CAD development, commissioned manufacturing, hand assembly, curated components, and combinations of existing jewelry elements.

Where ATABEY creates an original and legally protectable jewelry design or design element, Beechi LLC reserves all rights that may exist in that work under applicable copyright, trademark, trade dress, design patent, unfair competition, or other intellectual property laws.

Purchase of an ATABEY product does not grant the purchaser a right to reproduce, manufacture, commercially copy, distribute, license, or authorize production of an ATABEY-owned design except as otherwise permitted by applicable law.

3. THIRD-PARTY CHARMS, COMPONENTS & CURATED JEWELRY

Certain ATABEY products, particularly fashion jewelry, charm jewelry, curated collections, and assembled pieces, may incorporate charms, pendants, chains, findings, beads, gemstones, clasps, settings, or other components manufactured, designed, supplied, licensed, or made commercially available by third parties.

Beechi LLC and ATABEY Jewelry do not claim ownership of third-party intellectual property or exclusive rights in an individual third-party component merely because that component is incorporated into an ATABEY product.

The incorporation of third-party or commercially available components, however, does not necessarily eliminate rights that may independently exist in ATABEY’s original contributions to a finished piece, collection, or presentation.

To the fullest extent permitted by applicable law, Beechi LLC reserves any rights it may possess in original ATABEY contributions, including original:

  • Selection
  • Coordination
  • Arrangement
  • Combination
  • Modification
  • Customization
  • Assembly
  • Artistic expression
  • Photography
  • Styling
  • Packaging
  • Branding
  • Written content
  • Graphic presentation
  • Other independently protectable creative elements

Accordingly, the availability of an individual charm or component from another supplier does not grant permission to copy ATABEY-owned photographs, trademarks, branding, artwork, original modifications, proprietary designs, marketing materials, or other independently protected content.

Nothing in this section is intended to assert ownership over intellectual property legally belonging to another person or entity.

4. CULTURAL, HISTORICAL & PUBLIC-DOMAIN ELEMENTS

ATABEY celebrates and draws creative inspiration from Puerto Rican culture, history, architecture, nature, identity, and artistic heritage.

ATABEY products may therefore incorporate, reference, interpret, or draw inspiration from cultural symbols, geographic forms, historical subjects, architectural structures, traditional imagery, indigenous symbols, natural elements, public-domain works, or other shared cultural materials.

Beechi LLC does not claim exclusive ownership of Puerto Rican culture, Taíno heritage or symbols, historical facts, geographic shapes, public monuments, traditional symbols, public-domain works, or other underlying subject matter that cannot legally be exclusively owned.

However, an underlying cultural, historical, geographic, or public-domain subject may be expressed through an independently original artistic work.

Therefore, to the fullest extent permitted by applicable law, Beechi LLC reserves any rights it may possess in ATABEY’s specific original artistic interpretations, sculptural executions, ornamental details, modifications, arrangements, proportions, artwork, jewelry designs, photography, graphics, and other independently protectable expressions inspired by such subjects.

The public, historical, cultural, or geographic nature of an underlying subject does not necessarily place an independently original ATABEY expression of that subject into the public domain.

5. NO RIGHTS CLAIMED BEYOND APPLICABLE LAW

Nothing on this website or in this Legal Notice is intended to claim exclusive ownership over ideas, concepts, methods, techniques, functional features, generic jewelry forms, standard jewelry components, commercially available components, third-party designs, cultural heritage, historical facts, public-domain materials, or other subject matter that is not legally protectable.

Any assertion of intellectual property rights by Beechi LLC or ATABEY applies only to the extent such rights exist under applicable law.

Beechi LLC expressly reserves all rights legally available to it while disclaiming any intention to claim intellectual property rights that legally belong to third parties.

6. PHOTOGRAPHY, PRODUCT IMAGERY & CREATIVE CONTENT

Unless otherwise stated, original ATABEY photography, campaign imagery, product compositions, graphics, artwork, videos, and other protectable visual materials may be owned by or licensed to Beechi LLC.

Except as permitted by applicable law, such materials may not be copied, reproduced, republished, distributed, modified, sold, commercially exploited, or used to market another product, service, or business without appropriate authorization.

The fact that an ATABEY photograph depicts a third-party component, commercially available charm, cultural symbol, public-domain element, or otherwise non-exclusive subject does not automatically authorize reproduction of ATABEY’s independently protectable photograph or creative presentation.

Removal of ATABEY branding, logos, watermarks, or other identifiers from an image does not itself eliminate any intellectual property rights that may exist in the underlying material.

7. AI-GENERATED, AI-ASSISTED & DIGITALLY CREATED CONTENT

ATABEY may use artificial intelligence (“AI”), computer-generated imagery (“CGI”), CAD rendering, digital compositing, image generation, retouching, enhancement, background replacement, or other digital technologies in connection with product development, visualization, creative direction, editorial content, advertising, social media, marketing, and product presentation.

Some images appearing on ATABEY-operated platforms may therefore contain or consist of AI-generated, AI-assisted, digitally rendered, digitally enhanced, or composited elements.

Product Representation

Digitally generated or enhanced imagery is intended to provide a reasonable visual representation, creative visualization, or editorial presentation of the relevant product or concept.

Digital imagery may differ from a physical product in characteristics including lighting, reflections, apparent scale, color, texture, shadows, gemstone appearance, surface finish, proportions, positioning, or environmental details.

Customers should rely on the applicable written product description, materials, dimensions, specifications, and disclosures when evaluating the physical characteristics of a product.

Backgrounds, props, models, scenery, decorative elements, or other elements appearing in product imagery are not included with a purchase unless expressly stated.

Intellectual Property Within AI-Assisted Content

Beechi LLC does not claim intellectual property rights in purely AI-generated material to the extent such rights are unavailable under applicable law.

However, the use of AI, CGI, rendering software, image-editing software, or another digital technology does not constitute a waiver, abandonment, forfeiture, or dedication to the public of intellectual property rights that may independently exist in materials incorporated into, depicted within, or used in connection with such content.

To the fullest extent permitted by applicable law, Beechi LLC reserves any rights it may possess in independently protectable elements appearing within AI-assisted or digitally created materials, including:

  • Original ATABEY jewelry designs
  • Original human-created artwork
  • Original photography
  • Trademarks and logos
  • Brand identity
  • Original design modifications
  • Written content
  • Original graphic elements
  • Original CAD or design work
  • Other legally protectable human-authored contributions

The appearance of an ATABEY-owned design within an AI-generated, AI-assisted, rendered, or digitally modified image does not grant permission to manufacture, reproduce, distribute, or commercially exploit the underlying design.

Similarly, using AI or another technological tool to recreate, imitate, transform, or generate imagery based on ATABEY materials does not eliminate any independently existing rights Beechi LLC may possess in the underlying protected material.

8. TRADEMARKS & ATABEY BRAND IDENTITY

The ATABEY name, logos, trademarks, trade names, graphics, brand identifiers, and other source-identifying elements may be protected under applicable trademark, unfair competition, or related laws.

No person or entity may use ATABEY branding in a manner that falsely represents or is likely to create confusion regarding affiliation, authorization, sponsorship, endorsement, origin, or association with Beechi LLC or ATABEY Jewelry.

Nothing on this website grants a license to use ATABEY trademarks or brand identifiers except where expressly authorized in writing or otherwise permitted by applicable law.

9. COUNTERFEITING, COPYING, PASSING OFF & MISREPRESENTATION

Beechi LLC reserves all rights and remedies available under applicable law in connection with counterfeiting, passing off, false designation of origin, trademark infringement, copyright infringement, infringement of legally protected designs, deceptive trade practices, unfair competition, or other unlawful conduct involving ATABEY products, intellectual property, branding, or creative materials.

No person or business may falsely represent a product as being designed, manufactured, authorized, endorsed, sponsored, or sold by ATABEY when it is not.

Third-party products may not be advertised using ATABEY trademarks, logos, original photographs, original artwork, or other protected materials in a manner that falsely suggests an association with ATABEY.

Nothing in this section is intended to restrict lawful competition or any activity expressly protected under applicable law.

10. PRODUCT INFORMATION & VISUAL DIFFERENCES

ATABEY makes reasonable efforts to provide accurate product descriptions, photographs, dimensions, materials, colors, pricing, and specifications.

However, jewelry may exhibit reasonable variations resulting from manufacturing, hand-finishing, natural materials, production batches, plating processes, gemstone characteristics, assembly, or other characteristics inherent to jewelry production.

Natural gemstones, pearls, shells, mother-of-pearl, and similar materials may naturally vary in color, pattern, texture, inclusions, and appearance.

Colors and finishes may also appear differently depending on photography, lighting, screen calibration, device settings, rendering, or digitally created presentation materials.

Reasonable variations of this nature do not necessarily constitute defects, subject to any rights or remedies available to consumers under applicable law.

11. MEASUREMENTS & SPECIFICATIONS

Product measurements, dimensions, stone sizes, weights, and similar specifications may be approximate unless expressly identified as exact.

Handmade, hand-finished, made-to-order, customized, assembled, or independently manufactured products may exhibit minor variations from published measurements.

Customers should review the written description and specifications provided on the applicable product page before purchasing.

12. PRICING, AVAILABILITY & ERRORS

ATABEY makes reasonable efforts to maintain accurate pricing, product availability, descriptions, specifications, and other website information.

However, typographical, technical, pricing, inventory, photographic, or informational errors may occasionally occur.

To the extent permitted by applicable law, Beechi LLC reserves the right to correct errors, inaccuracies, or omissions and update website information.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Beechi LLC d/b/a ATABEY Jewelry will not be liable for indirect, incidental, special, consequential, or similar damages arising solely from access to, use of, or inability to access this website.

Nothing in this Legal Notice excludes, restricts, or limits liability, remedies, warranties, or consumer rights that cannot legally be excluded, restricted, or limited under applicable law.

All rights not expressly granted are reserved.
