ATABEY Jewelry (“ATABEY,” “we,” “us,” or “our”) is a DBA (Doing Business As) of Beechi LLC.

ATABEY operates this store and website, including all related information, content, features, tools, products, and services made available to you in order to provide our customers with a curated shopping experience (collectively, the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

However, product appearance may vary slightly due to:

Manufacturing tolerances;
Hand-finishing;
Production methods;
Natural variations in stones, pearls, shells, metals, and other materials;
Different production batches; and
Scale or perspective in photographs, videos, or renderings.

We cannot guarantee that your device will display every color, finish, texture, proportion, or other visual characteristic with absolute accuracy.

Minor variations that do not materially affect the identity, functionality, or overall design of a product are not necessarily manufacturing defects.

Unless expressly stated otherwise, measurements, dimensions, stone sizes, chain lengths, weights, and other specifications may be approximate and may be subject to reasonable manufacturing tolerances.

Product descriptions, specifications, pricing, availability, designs, and other information may be updated or corrected from time to time.

We reserve the right to discontinue any product or collection at any time and, where permitted by applicable law, to limit quantities available to any person, household, geographic region, or jurisdiction.

Nothing in this section limits any rights or remedies that cannot legally be waived.

SECTION 3 — JEWELRY MATERIALS, FINISHES & NATURAL VARIATIONS

Jewelry naturally experiences wear over time.

Depending on the material, construction, finish, frequency of wear, environmental conditions, body chemistry, and manner of use, jewelry may experience:

Tarnishing;
Oxidation;
Scratching;
Discoloration;
Plating wear;
Fading;
Loss of shine;
Surface changes; or
Other signs of normal wear.

Exposure to water, saltwater, chlorine, perfumes, cosmetics, lotions, cleaning products, household chemicals, humidity, sweat, excessive heat, or other substances may affect certain jewelry materials, stones, coatings, plating, adhesives, and finishes.

Natural gemstones may contain naturally occurring variations in color, clarity, inclusions, texture, pattern, shape, or appearance.

Lab-created gemstones may also exhibit reasonable differences resulting from cutting, manufacturing, setting, or production.

Such variations are not necessarily defects.

Customers are responsible for following any care recommendations provided by ATABEY for the applicable product.

SECTION 4 — ALLERGIES & SKIN SENSITIVITIES

Product material information is provided where reasonably available so customers can make informed purchasing decisions.

Certain ATABEY products, components, findings, chains, clasps, charms, stones, coatings, plating, finishes, adhesives, alloys, or other materials may be manufactured, supplied, plated, assembled, or processed by independent third-party manufacturers or suppliers.

Individual reactions to jewelry materials vary from person to person.

ATABEY cannot guarantee that any product will be suitable for every individual’s skin or that a customer will not experience irritation, sensitivity, discoloration, or an allergic reaction.

If you experience irritation, redness, swelling, itching, burning, discomfort, rash, or any other adverse reaction while wearing an ATABEY product, discontinue use immediately.

If symptoms persist, worsen, or are severe, seek guidance from an appropriate healthcare professional.

Customers with known allergies or sensitivities are responsible for reviewing available material information before purchasing or wearing an item and determining whether the product is appropriate for them.

Some material specifications and composition information provided by ATABEY may be based on certifications, descriptions, specifications, or other information supplied to us by third-party manufacturers or suppliers.

While we make reasonable efforts to provide accurate product information, ATABEY does not independently manufacture or laboratory-test every individual component for allergens, trace metals, chemical composition, or other substances unless expressly stated otherwise.

To the fullest extent permitted by applicable law, ATABEY Jewelry and Beechi LLC are not responsible for individual allergic reactions or sensitivities to materials, components, coatings, plating, finishes, adhesives, alloys, or other substances contained in products manufactured or supplied by third parties when ATABEY has accurately represented the material information reasonably available to us from those manufacturers or suppliers.

Customers with severe or known metal allergies or sensitivities should exercise appropriate caution before purchasing or wearing jewelry.

Continued use of a product after an adverse reaction becomes apparent is not recommended.

Nothing in this section excludes or limits any liability or consumer right that cannot legally be excluded or limited.

SECTION 5 — THIRD-PARTY MANUFACTURERS, SUPPLIERS & COMPONENTS

ATABEY may work with independent manufacturers, jewelers, workshops, artisans, suppliers, fulfillment partners, component manufacturers, plating facilities, stone suppliers, and other third parties in connection with the design, manufacture, sourcing, assembly, finishing, or fulfillment of our products.

Certain products may therefore contain materials or components manufactured or supplied by third parties.

We make reasonable efforts to work with manufacturers and suppliers whose product specifications are consistent with the products we offer.

However, certain technical information regarding materials, composition, manufacturing processes, coatings, plating, alloys, stones, findings, or other components may originate from those third parties.

To the fullest extent permitted by applicable law, ATABEY Jewelry and Beechi LLC are not responsible for inaccurate, incomplete, or undisclosed information supplied to us by an independent manufacturer or supplier that ATABEY could not reasonably have known was inaccurate, incomplete, or undisclosed.

Nothing in this section limits any responsibility that applicable law specifically requires ATABEY Jewelry or Beechi LLC to assume.

SECTION 6 — PRODUCT IMAGES, RENDERINGS & AI-ASSISTED IMAGERY

Our website, social media, advertisements, catalogs, emails, and other marketing or product materials may contain:

Traditional photography;
Digitally enhanced photography;
Retouched photography;
CAD renderings;
Computer-generated imagery;
Digital illustrations;
Artistic representations;
AI-assisted imagery;
AI-generated imagery;
Mockups; or
Other digital visualizations.

These materials may be used to illustrate a product, design, concept, scale, styling, environment, presentation, or intended appearance.

Digital representations are intended to provide a reasonable visual reference and may not reproduce every physical characteristic of the final product with absolute precision.

Customers should review the written product description, materials, dimensions, specifications, and other applicable information before purchasing rather than relying solely on imagery.

The use of artificial intelligence, computer-generated imagery, digital enhancement, CAD software, rendering software, or similar technological tools in creating or presenting ATABEY content does not constitute permission for third parties to copy, reproduce, manufacture, distribute, sell, imitate, or otherwise commercially exploit ATABEY’s underlying designs, artwork, branding, photographs, compositions, creative direction, or other protectable materials.

SECTION 7 — ORDERS & ORDER ACCEPTANCE

When you place an order through our Services, you are making an offer to purchase the applicable products.

Submission of an order does not necessarily constitute final acceptance of that order by ATABEY.

We reserve the right, where permitted by applicable law, to accept, reject, limit, verify, or cancel an order for legitimate business or security reasons, including circumstances involving:

Suspected fraud;
Unauthorized transactions;
Payment verification problems;
Pricing or listing errors;
Inventory discrepancies;
Product or material unavailability;
Stone or component unavailability;
Manufacturing limitations;
Unusually large quantities;
Suspected unauthorized commercial resale;
Abuse of promotions or store policies; or
Circumstances that reasonably prevent fulfillment.

Payment authorization or processing does not necessarily constitute final acceptance of an order.

If we decline or cancel a paid order that has not been fulfilled, we will refund the applicable amount as required by our policies and applicable law.

We may attempt to notify you of a cancellation, modification, verification request, or other order issue using the email address, billing information, shipping information, telephone number, or other contact information supplied with the order.

Please carefully review your order before completing your purchase.

After an order has been accepted or entered production or processing, ATABEY may no longer be able to accommodate cancellation or modification requests.

Cancellation eligibility is governed by our Cancellation Policy.

SECTION 8 — MADE-TO-ORDER PRODUCTS

Certain ATABEY products are produced specifically after an order is placed.

Made-to-order products may require manufacturing, material sourcing, stone sourcing, casting, plating, finishing, assembly, inspection, quality control, or other production processes before shipment.

Production and fulfillment timeframes displayed on our website are estimates unless expressly identified as guaranteed.

Once production, material sourcing, manufacturing, personalization, preparation, or other order-specific processing has begun, cancellation or modification may no longer be possible.

By purchasing a made-to-order product, you acknowledge that the product may not be immediately available for shipment and agree to the applicable production timeframe disclosed with the product.

Please review our Cancellation Policy, Shipping Policy, and Returns & Refunds Policy before purchasing a made-to-order product.

SECTION 9 — CUSTOM & PERSONALIZED PRODUCTS

Custom, engraved, modified, personalized, specially sized, or otherwise individually produced items may be final sale where permitted by applicable law and as disclosed in our Returns & Refunds Policy.

Customers are responsible for carefully reviewing all information supplied for customization, including:

Names;
Initials;
Dates;
Measurements;
Sizes;
Spelling;
Stone selections;
Metal selections;
Design specifications; and
Other personalized details.

ATABEY is not responsible for errors contained in customization information submitted or expressly approved by the customer, except where applicable law provides otherwise.

Once custom production begins, modifications or cancellations may no longer be possible.

If ATABEY agrees to a modification after production has begun, additional charges and additional production time may apply.

SECTION 10 — PRE-ORDERS

A pre-order allows a customer to reserve a product that is not currently available for immediate shipment.

Pre-order production dates, estimated availability dates, and estimated shipping dates are estimates unless expressly stated otherwise.

Timelines may change due to:

Manufacturing schedules;
Material availability;
Stone or component availability;
Quality-control requirements;
Transportation;
Customs processing;
Supply-chain interruptions;
Production delays; or
Other circumstances outside our reasonable control.

By purchasing a pre-order product, you acknowledge that the product is not necessarily available for immediate shipment.

A pre-order may become non-cancelable once production, preparation, material sourcing, manufacturing, or other order-specific processing has begun, subject to our Cancellation Policy and applicable law.

SECTION 11 — PRICES, BILLING & PAYMENT

Prices, discounts, and promotions are subject to change without notice.

The price charged for a product will ordinarily be the price displayed when the order is submitted and will be reflected in the applicable order confirmation, subject to correction of obvious errors where permitted by law.

Unless expressly stated otherwise, displayed prices may not include applicable taxes, shipping charges, handling charges, customs duties, import fees, or other charges.

Prices available through our online store may differ from prices offered through other sales channels, marketplaces, retailers, events, or third-party platforms.

From time to time, we may offer promotions subject to additional terms. If promotion-specific terms conflict with these Terms with respect to that promotion, the promotion-specific terms will govern to the extent of the conflict.

You agree to provide current, complete, and accurate purchase, billing, shipping, payment, and account information.

By providing a payment method, you represent that:

The payment information you provide is true, accurate, and complete;
You are authorized to use the applicable payment method;
Charges incurred by you may be submitted to the applicable payment provider; and
You are responsible for the amounts properly charged in connection with your purchase, including applicable taxes and shipping or handling charges.

Payments may be processed by independent third-party payment processors and may be subject to their own terms and privacy practices.

SECTION 12 — PRICING, TYPOGRAPHICAL & LISTING ERRORS

Our Services may occasionally contain typographical errors, inaccuracies, omissions, technical errors, incorrect pricing, incorrect inventory information, inaccurate descriptions, promotional errors, shipping information errors, or other mistakes.

We reserve the right to correct errors, inaccuracies, or omissions and to update information when discovered.

Where permitted by applicable law, we may modify or cancel an affected order when material information relating to that order was clearly erroneous.

If a paid order is canceled by ATABEY because of such an error, the applicable amount paid for the canceled portion will be refunded.

Nothing in this section limits rights that applicable law does not permit us to waive.

SECTION 13 — SHIPPING & DELIVERY

Shipping and delivery are governed by our Shipping Policy.

Production time and carrier transit time are separate.

Any production, shipping, delivery, or arrival date displayed or communicated is an estimate unless expressly stated as guaranteed.

Delivery may be affected by circumstances outside ATABEY’s reasonable control, including:

Carrier delays;
Weather;
Natural disasters;
Transportation disruptions;
Customs processing;
Government actions;
Incorrect or incomplete addresses;
Security interruptions;
Labor disruptions; or
Other logistical circumstances.

Customers are responsible for providing a complete and accurate shipping address.

Where permitted by applicable law, additional shipping or handling expenses resulting from an incorrect or incomplete address supplied by the customer may be the customer’s responsibility.

Risk of loss, title, carrier responsibility, and available remedies will be determined in accordance with the applicable shipment terms and governing law.

Nothing in these Terms is intended to eliminate any non-waivable consumer protection applicable to lost, damaged, misdelivered, or undelivered orders.

SECTION 14 — RETURNS, REFUNDS & CANCELLATIONS

Returns, exchanges, refunds, store credit, eligibility requirements, exclusions, and applicable deadlines are governed by our Returns & Refunds Policy.

Order cancellations are governed by our Cancellation Policy.

Submitting a cancellation request does not guarantee that an order can be canceled.

Made-to-order, custom, personalized, modified, or pre-order products may become non-cancelable once production, manufacturing, sourcing, personalization, preparation, or other order-specific processing has begun.

Returned merchandise must satisfy the requirements contained in our Returns & Refunds Policy before a return, refund, exchange, or store credit may be issued.

Nothing in these policies limits any consumer rights or remedies that cannot legally be waived.

SECTION 15 — REPAIRS, SIZING & PRODUCT CARE

Repair, resizing, restoration, replating, stone replacement, or other services may be subject to separate eligibility requirements, charges, timelines, and conditions.

Normal wear and tear, accidental damage, improper storage, misuse, unauthorized repairs, exposure to inappropriate chemicals or environments, and failure to follow applicable care instructions are not necessarily manufacturing defects.

A repair, alteration, resizing, plating, soldering, stone replacement, or other modification performed by an unauthorized third party may affect eligibility for ATABEY repair services or remedies where the third-party work has altered, compromised, or damaged the product.

SECTION 16 — PROMOTIONS, DISCOUNT CODES & STORE CREDIT

Promotions, discounts, promotional gifts, discount codes, store credits, and special offers may be subject to separate terms.

Unless otherwise stated:

Promotional codes may not be combined;
Promotional codes cannot be applied retroactively;
Promotions have no cash value;
Certain products or collections may be excluded;
Promotions may be modified or discontinued where permitted by law; and
Store credit cannot be redeemed for cash except where required by law.

We reserve the right to reject unauthorized, fraudulent, manipulated, or abusive use of promotions or discount codes.

SECTION 17 — GIFT CARDS

Gift cards are subject to any additional terms displayed at the time of purchase and applicable law.

Gift cards are not redeemable for cash except where required by law.

Customers are responsible for protecting gift card information from unauthorized access or use.

Any expiration dates, fees, refunds, replacement rights, and other conditions applicable to gift cards will be governed by applicable law and the terms disclosed with the gift card.

SECTION 18 — INTELLECTUAL PROPERTY

The Services and ATABEY’s content may include intellectual property owned by, licensed to, or lawfully used by ATABEY Jewelry, Beechi LLC, Shopify, or other third parties.

This may include, without limitation:

The ATABEY name and branding;
Logos;
Product names;
Original jewelry designs;
Original design elements;
Drawings;
CAD designs and models;
Illustrations;
Graphics;
Photographs;
Videos;
Audio;
Renderings;
Website content;
Product descriptions;
Written materials;
Packaging;
Advertising materials;
Layouts;
Creative assets; and
The selection and arrangement of such materials.

These materials may be protected by copyright, trademark, trade dress, patent, or other intellectual-property laws to the extent applicable.

These Terms permit you to use the Services for personal, lawful, and non-commercial purposes.

Except where permitted by applicable law or expressly authorized by us in writing, you may not reproduce, distribute, modify, publicly display, republish, download for commercial exploitation, manufacture from, sell copies of, or create unauthorized derivative commercial works from protected ATABEY or Beechi LLC materials.

Nothing in these Terms transfers to you any ownership interest in ATABEY, Beechi LLC, Shopify, or third-party intellectual property.

Purchasing an ATABEY product does not transfer intellectual-property rights in the design of that product and does not grant authorization to commercially reproduce, manufacture, copy, or distribute the design.

Any Shopify names, logos, products, service names, designs, or slogans appearing through the Services remain the property of Shopify or its applicable licensors.

Other third-party trademarks remain the property of their respective owners.

All rights not expressly granted are reserved.

SECTION 19 — CULTURAL, HISTORICAL & PUERTO RICAN SYMBOLS

ATABEY Jewelry celebrates and artistically interprets elements of Puerto Rican culture, history, architecture, geography, nature, traditions, and shared visual heritage.

ATABEY does not claim exclusive ownership over Puerto Rican culture, historical facts, geographic shapes, traditional symbols, public-domain imagery, architectural subjects, cultural heritage, or other elements that cannot legally be privately owned.

However, ATABEY may own or assert applicable intellectual-property rights in its specific original artistic expressions, interpretations, compositions, arrangements, drawings, models, jewelry designs, photographs, renderings, branding, and other independently protectable creative work incorporating such elements.

The fact that a product is inspired by a cultural, architectural, geographic, historical, or natural subject does not automatically place ATABEY’s specific original artistic expression of that subject into the public domain.

SECTION 20 — THIRD-PARTY CHARMS, FINDINGS & DESIGN COMPONENTS

Certain ATABEY products may incorporate lawfully sourced charms, chains, clasps, findings, stones, beads, components, or other elements manufactured or supplied by third parties.

ATABEY does not claim intellectual-property ownership over third-party components where those rights belong to another party.

The incorporation of a commonly available or third-party component, however, does not grant another person rights to ATABEY’s independently protectable:

Original design elements;
Original combinations or arrangements where protectable;
Branding;
Photography;
Renderings;
Product styling;
Creative compositions;
Packaging;
Graphics;
Written content; or
Other original materials.

SECTION 21 — PROHIBITED COMMERCIAL USE

Except where permitted by law or expressly authorized by ATABEY in writing, you may not use ATABEY-owned photographs, renderings, graphics, logos, branding, original artwork, product descriptions, or other protected content to manufacture, advertise, market, or sell products.

You may not falsely represent yourself or another person or business as:

ATABEY Jewelry;
Beechi LLC;
An authorized ATABEY retailer;
An ATABEY distributor;
An ATABEY partner;
An ATABEY employee;
An ATABEY representative; or
An ATABEY affiliate.

Nothing in this section restricts lawful criticism, commentary, fair use, resale, or other activity protected under applicable law.

SECTION 22 — OPTIONAL THIRD-PARTY TOOLS

We may provide access through the Services to tools, applications, integrations, or functionality provided by third parties that we do not fully monitor or control.

You acknowledge that such third-party tools may be provided “as is” and “as available,” subject to applicable law and any terms imposed by the applicable third-party provider.

Your use of optional third-party tools is at your discretion, and you are responsible for reviewing the terms under which the applicable provider makes those tools available.

We may also introduce new features, resources, integrations, or tools in the future.

Unless otherwise stated, such additions will be considered part of the Services and subject to these Terms.

The Services may contain links to, integrations with, embedded functionality from, or other materials provided by independent third parties.

We do not necessarily control, endorse, or verify all content, accuracy, products, practices, security, or policies of those third parties.

To the fullest extent permitted by applicable law, ATABEY and Beechi LLC are not responsible for independent third-party websites, services, content, products, or practices that are outside our reasonable control.

Questions or claims regarding a product or service purchased directly from an independent third party should ordinarily be directed to that third party.

SECTION 24 — RELATIONSHIP WITH SHOPIFY

ATABEY Jewelry is powered by Shopify, which enables us to provide the Services to you.

However, any sale or purchase you make through our store is made directly between you and ATABEY Jewelry.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales transaction between you and ATABEY Jewelry, including any injury, damage, or loss resulting from products or services purchased from ATABEY Jewelry.

To the extent permitted by applicable law, you expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to your purchase and transaction with ATABEY Jewelry.

Where appropriate, this may include displaying customer reviews, testimonials, or customer-submitted photographs in connection with our website, social media, advertising, email, or other promotional materials.

You represent and warrant that:

You own or otherwise have the necessary rights to the Feedback you submit;
You have disclosed any compensation or incentive you received in connection with a review where disclosure is required;
Your Feedback does not unlawfully infringe the rights of another person; and
Your Feedback complies with these Terms and applicable law.

Feedback must not contain unlawful, defamatory, abusive, obscene, fraudulent, malicious, infringing, or harmful content or computer viruses, malware, or similar technology intended to disrupt the Services.

Where we cancel a paid but unfulfilled order, we will issue the applicable refund.

To otherwise use the Services in a manner that could reasonably damage ATABEY, Beechi LLC, Shopify, our customers, or our service providers.

Except where expressly permitted by us or by applicable law, you may not use scraping technology, automated extraction systems, robots, spiders, data-mining tools, automated AI systems, agentic AI systems, or similar automated or manual methods to access, collect, extract, reproduce, or commercially exploit protected content from the Services.

We reserve the right to suspend or terminate access where we reasonably determine that these Terms have been materially violated.

SECTION 29 — SOFTWARE AGENTS & AUTOMATED SYSTEMS

This section applies if you use, enable, authorize, or cause an automated or semi-automated software system (“Agent”) to access, use, or interact with the Services.

Orders may be delayed, canceled, restricted, or subject to additional verification where reasonably necessary to protect customers, ATABEY Jewelry, Beechi LLC, payment processors, Shopify, or other parties.

Fraudulent transactions, identity theft, impersonation, knowingly false payment disputes, intentional chargeback abuse, or other unlawful conduct may be reported to payment processors, financial institutions, platforms, or appropriate authorities where warranted.

Nothing in these Terms restricts a customer’s lawful right to dispute a genuinely unauthorized, fraudulent, undelivered, materially nonconforming, or otherwise legally disputable transaction.

Unless otherwise agreed, purchases from ATABEY are primarily intended for personal or household use.

Purchasing ATABEY products for resale does not make the purchaser an authorized ATABEY retailer, distributor, dealer, partner, representative, or affiliate.

No person or business may represent or imply an official affiliation with ATABEY or Beechi LLC without authorization.

Nothing in this section prohibits lawful resale where applicable law protects such activity.

SECTION 32 — AVAILABILITY OF PRODUCTS & SERVICES

Certain products may be available exclusively online or may be produced in limited quantities.

We reserve the right to discontinue products, designs, collections, colors, sizes, finishes, materials, services, or other offerings at any time.

We do not guarantee that a previously available product will be restocked or reproduced.

We may limit quantities where reasonably necessary and permitted by law.

We may suspend or terminate your access to all or part of the Services where permitted by law, including where we reasonably determine that you have materially violated these Terms, engaged in unlawful activity, compromised the security of the Services, or abused our systems or policies.

Termination does not eliminate payment obligations validly incurred before termination.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM IMPLIED WARRANTIES THAT MAY OTHERWISE APPLY, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

Continued use of a product after the customer becomes aware that it is causing irritation, injury, sensitivity, or another adverse reaction.

As described elsewhere in these Terms, ATABEY may rely on material or component specifications supplied by independent manufacturers or suppliers.

To the fullest extent permitted by applicable law, ATABEY and Beechi LLC will not be responsible for an undisclosed characteristic of a third-party manufactured material that ATABEY could not reasonably have known about and did not misrepresent.

Nothing in these Terms excludes, waives, or limits liability for conduct or circumstances for which applicable law prohibits such exclusion or limitation.

Nothing in these Terms limits any mandatory consumer rights available to you.

SECTION 36 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Beechi LLC, doing business as ATABEY Jewelry, and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from third-party claims, damages, liabilities, losses, and reasonable expenses, including reasonable attorneys’ fees, arising from:

Your material breach of these Terms or policies incorporated by reference;
Your unlawful use of the Services;
Your violation of applicable law; or
Your infringement of the rights of another person.

We will provide reasonable notice of an indemnifiable claim where appropriate.
